Obama administration to support repeal of Defense of Marriage Act. The announcement follows President Obama’s decision on Feb. 23, 2011 to instruct the Justice Department to stop defending DOMA, the federal law that defines marriage as a legal union between a man and woman, over concerns that it violates the equal protection component of the Fifth Amendment. Sen. Dianne Feinstein’s (D-CA) bill to repeal the Defense of Marriage Act (DOMA) currently has 27 co-sponsors for the Respect for Marriage Act.
